GENERAL TERMS & CONDITIONS – Maria & Amahle


Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

Withdrawal period: the period during which the consumer may exercise the right of withdrawal.
Consumer: the natural person who is not acting in the course of a profession or business and who enters into a distance contract with the trader.
Day: calendar day.
Continuous transaction: a distance contract relating to a series of products and/or services for which the obligation of delivery and/or purchase extends over time.
Durable medium: any tool that allows the consumer or trader to store information addressed personally to them in a way that enables future consultation for a period adequate to its purpose and reproduction without alteration.
Right of withdrawal: the consumer’s option to withdraw from the distance contract within the withdrawal period.
Trader: the natural or legal person offering products and/or services to consumers at a distance.
Distance contract: any contract concluded within the framework of a system organised by the trader for the distance sale of products and/or services, whereby only one or more distance communication techniques are used up to and including the conclusion of the contract.
Distance communication technique: a means that can be used to conclude a contract without the consumer and trader simultaneously being in the same place.
General Terms and Conditions: these General Terms and Conditions of the trader.

Article 3 – Scope

These General Terms and Conditions apply to every offer from the trader and to every distance contract and order concluded between the trader and the consumer.

Before concluding a distance contract, the consumer shall be provided with the text of these General Terms and Conditions. If this is not reasonably possible, the trader shall indicate before the contract is concluded where the Terms may be consulted and that they will be sent to the consumer free of charge upon request.

If a distance contract is concluded electronically, the text of the Terms may be provided electronically in such a way that the consumer can easily store it on a durable medium. If this is not reasonably possible, the trader shall indicate where they can be consulted electronically and that they will be sent electronically or otherwise free of charge upon request.

If specific product or service conditions also apply, the same principles apply, and in the event of conflicting conditions, the consumer may always rely on the provision most favourable to them.

If any provision is void or annulled, the remaining provisions shall remain in effect. The invalid provision shall be replaced by a provision that most closely reflects the original intent.

Situations not provided for in these Terms shall be assessed “in accordance with the spirit” of these Terms.
Ambiguities shall also be interpreted “in accordance with the spirit” of these Terms.


Article 4 – The Offer

If an offer has limited validity or is subject to conditions, this will be explicitly stated.

The offer is non-binding. Maria & Amahle may modify or adjust the offer at any time.

The offer contains a complete and accurate description of the products and/or services offered, enabling the consumer to make an informed decision. Images used are a truthful representation of the product or service. Obvious mistakes or errors do not bind the trader.

All images and specifications in the offer are indicative and may not give rise to compensation or termination of the contract.

Colours displayed may vary slightly from reality depending on screens and lighting.

Each offer includes clear information on:

  • the price (including taxes);

  • possible shipping costs;

  • how the contract will be concluded;

  • whether the right of withdrawal applies;

  • method of payment, delivery, and execution;

  • validity of the offer;

  • distance communication charges (if different from the standard rate);

  • whether the contract will be archived and how to access it;

  • how the consumer may check and correct submitted data;

  • languages available for the contract;

  • applicable codes of conduct;

  • minimum contract duration for continuous transactions;

  • optional: available sizes, colours, materials.


Article 5 – The Contract

The contract is concluded when the consumer accepts the offer and meets the required conditions.

If accepted electronically, Maria & Amahle shall confirm receipt of the acceptance electronically without delay. Until the confirmation is sent, the consumer may dissolve the contract.

If concluded electronically, Maria & Amahle shall ensure appropriate technical and organisational measures to secure data transmission and ensure a safe shopping environment.

Maria & Amahle may, within legal limits, assess whether the consumer can meet financial obligations and review relevant factors for a responsible conclusion of the contract. If justified, the trader may refuse an order or attach special conditions.

The trader shall provide the consumer with the following information at the latest at the time of delivery:

a. the physical address for submitting complaints;
b. withdrawal conditions or exclusions;
c. warranty and after-sales information;
d. information listed in Article 4(3), unless already provided;
e. conditions for terminating contracts longer than one year or indefinite.

For continuous transactions, this information applies only to the first delivery.

The contract is concluded under the condition of sufficient product availability.


Article 6 – Right of Withdrawal

For product purchases, the consumer may withdraw from the contract within 30 days of receiving the product.

During the withdrawal period, the consumer must handle the product and packaging with care and only unpack or use it as necessary to determine the product’s nature, characteristics, and function.

If exercising the right of withdrawal, the consumer must return the product—including accessories, in original condition and packaging—to the indicated return address, following the trader’s instructions.

⚠️ Returns are processed through our overseas warehouse.
The consumer is responsible for proper return shipping and return shipping costs.
Sending with Track & Trace is strongly recommended.

The consumer must notify the trader in writing (email or letter) within 30 days of receiving the product. After notification, the consumer has another 30 days to return the product.

If the consumer does not notify or does not return the product in time, the purchase becomes final.


Article 7 – Costs in Case of Withdrawal

General rule
Return shipping costs are borne by the consumer unless otherwise agreed.

International return address
Returns are processed via the trader’s overseas warehouse. Costs depend on the carrier, weight, and dimensions.

Responsibility
The consumer is responsible for correct packaging and shipping.
Track & Trace shipping is strongly recommended.

Incorrect, damaged, or faulty products
If a product is incorrect, damaged, or defective, all return costs are covered by Maria & Amahle.

Refunds
The trader will refund all payments made by the consumer, including standard delivery costs of the original order, within 5 working days after receiving the return.
Partial returns result in partial refunds.

Exclusions
Additional delivery costs chosen by the consumer (e.g., express shipping) will not be refunded.


Article 8 – Exclusion of the Right of Withdrawal

The trader may exclude the right of withdrawal for:

Products:
a. made according to consumer specifications;
b. clearly personal in nature;
c. that cannot be returned due to their nature;
d. that deteriorate rapidly;
e. subject to financial market fluctuations;
f. magazines or newspapers;
g. audio/video recordings or software once sealed packaging is broken;
h. hygienic products whose seal is broken.

Services:
a. relating to accommodation, transport, catering, leisure on a specific date;
b. begun with consumer consent before the withdrawal period ended;
c. relating to gambling and lotteries.


Article 9 – Price

Prices will not be increased during the offer period except due to VAT changes.

Products subject to financial market fluctuations may have variable prices.

Price increases within three months after the contract are only permitted due to legal changes.

After three months, increases are allowed only if stated in the contract and the consumer may cancel from the day the increase takes effect.

Prices include VAT.
Typographical errors are not binding.


Article 10 – Conformity and Warranty

Maria & Amahle guarantees that products/services comply with the contract, description, quality expectations, and legal requirements.

Any defect must be reported in writing within 30 days of delivery.
Products must be returned in original packaging and unused condition.

Warranty equals the manufacturer’s warranty period.

Warranty is void if:

  • the consumer repairs/modifies the product;

  • product misuse or abnormal conditions occur;

  • defects arise from governmental regulations regarding materials.


Article 11 – Delivery and Execution

Maria & Amahle acts with care when accepting and executing orders.

Delivery address is the address provided by the consumer.

Orders are delivered within 30 days unless agreed otherwise.
Delays will be communicated within 30 days; the consumer may cancel free of charge.

If cancelled, refunds will be issued within 14 days.

If a product is unavailable, a substitute item may be provided—clearly stated at delivery.
Return shipping for substitute items is free.

Risk transfers to the consumer upon delivery.


Article 12 – Continuous Contracts: Duration, Termination & Renewal

Consumers may terminate contracts of indefinite duration with one-month notice.

Fixed-term contracts may be terminated at the end of the term with one-month notice.

Contracts cannot be tacitly renewed for fixed periods except:

  • magazines/newspapers: max 3-month renewal with one-month cancellation.

Contracts may be tacitly renewed for indefinite duration if consumer can cancel with one-month notice (three months for less frequent magazine deliveries).

Trial subscriptions end automatically.

Contracts longer than one year may be cancelled after one year with one-month notice.


Article 13 – Payment

Payments must be made within 7 working days unless otherwise agreed.

The consumer must report incorrect payment details immediately.

In case of non-payment, the trader may charge reasonable costs if communicated in advance.


Article 14 – Complaints Procedure

Complaints must be submitted within 7 days, clearly described.

Maria & Amahle responds within 14 days.
If more time is needed, an acknowledgment with a timeline will be provided.

Unresolved complaints may lead to dispute procedures.

Submitting a complaint does not suspend consumer obligations.

If a complaint is justified, the trader will repair or replace the product free of charge.


Article 15 – Disputes

Only Dutch law applies to contracts between the consumer and Maria & Amahle, even if the consumer resides abroad.
